Announcements

When the continuous alarm sounds you must evacuate the building by the nearest available fire exit. Members and visitors should proceed to the visitors’ car park at the front of the building and await further instructions (during office hours staff should proceed to their usual assembly point; outside of office hours proceed to the visitors’ car park). Please do not re-enter the building unless instructed to do so.

 

In the event of a fire any person with a disability should be assisted in leaving the building.

31.1          The evacuation procedure, as noted on the Agenda, was advised to those present.

31.2           The Chair gave a brief outline of the scheme and the procedure for Planning Committee meetings including public speaking.

Minutes:

34.1          A Member drew attention to Minute No. PL.29.54 in relation to application 19/00537/APP – Phase 1, Land at Perrybrook, North Brockworth, which stated that: ‘....the Legal Adviser explained that it would be necessary to go back to the original application to obtain those details; notwithstanding this, she provided assurance that Officers were clear that Members wished to secure the highways improvements prior to occupation of the dwellings’.  It was his understanding that Members had asked Officers to go back to the developer to seek the highway improvements on Mill Lane before the development commenced.  The Planning and Enforcement Team Leader (South) indicated that it was his recollection that this related to one of the outline conditions which allowed a certain number of units to be occupied and that the request was in respect of occupations rather than commencement of development.   Another Member indicated that that was not his recollection which was that it was commencement of development.  The Legal Adviser clarified that, if Members remained of the view that the Minutes were inaccurate in this regard, a proposal would need to be moved, seconded and voted upon if and it was subsequently proposed and seconded that Minute No. PL.29.54 be amended to read: ‘....the Legal Adviser explained that it would be necessary to go back to the original application to obtain those details; notwithstanding this, she provided assurance that Officers were clear that Members wished to secure the highways improvements prior to occupation of the dwellings commencement of development.  Upon being put to the vote it was

Minutes:

35.1           The Technical Planning Manager submitted a Schedule comprising planning applications and proposals with recommendations thereon.  Copies of this had been circulated to Members as Appendix A to the Agenda for the meeting.  The objections to, support for, and observations upon the various applications as referred to in Appendix 1 attached to these Minutes were presented to the Committee and duly taken into consideration by Members prior to decisions being made on those applications.

18/00770/FUL – Saberton Farm, Beckford Road, Dumbleton

35.2          This application was for change of use of former wholesale plant nursery to builders’ yard; conversion of existing barn to office use; erection of storage buildings; retention of tile manufacturing operations; and installation of associated infrastructure.

35.3          The Planning Officer advised that the application related to Saberton Farm, a former horticultural nursery located to the west of Dumbleton, adjacent to the A46 and Beckford Road.  The site lay within the Area of Outstanding Natural Beauty and Flood Zone 1.  The proposal was for the change of use of the site to a builders’ yard and tile manufacturer with various other works including two new storage buildings, the conversion of an existing stone barn to an office and re-covering of a number of existing poly-tunnels.  The applicant had advised that the site was required for the relocation and growth of their business and that no other alternative suitable sites had been found.  The main issues in the consideration of the application were the principle of the development, impact on the Area of Outstanding Natural Beauty, ecology and highway safety.  In terms of the principle of development, the application proposed an employment-generating use within the open countryside in conflict with Joint Core Strategy Policy SD1 which set out appropriate employment types and locations; however, it was noted that the National Planning Policy Framework was more supportive of employment uses beyond existing settlements which met local business requirements and this needed to be weighed in the benefits of the scheme.  Whilst the proposal would introduce more built development, the application also proposed the removal of uncharacteristic Leylandii belts and the installation of additional native tree and hedgerow planting.  Additional details in respect of the external storage of materials had been received and were set out in the Additional Representations Sheet, attached at Appendix 1. The heights and locations for external storage were considered appropriate and would be adequately screened from the wider area and, subject to compliance with conditions, it was considered that the scenic beauty of the Area of Outstanding Natural Beauty would be conserved.  The submitted reports indicated that the site was of limited ecological value; however, a Brown Eared Bat had been recorded in the stone barn which was proposed for conversion.  Having had regard to the Conservation of Habitats and Species Regulations, it was considered that, subject to compliance with conditions, the proposal would have no detrimental effect on the conservation status of the bat.  Highways England and County Highways had confirmed there would be no  ...  view the full minutes text for item 35a

To consider current planning and enforcement appeals and Ministry of Housing, Communities and Local Government (MHCLG) appeal decisions.

Minutes:

36.1          Attention was drawn to the current appeal and appeal decisions update, circulated at Pages No. 26-32.  Members were asked to consider the current planning and enforcement appeals received and the Ministry of Housing, Communities and Local Government appeal decisions issued.

36.2          In response to a Member query, the Technical Planning Manager advised that the appeal in relation to Stoke Road, Bishop’s Cleeve had been allowed and would be included in the report to the next meeting.  Members were informed that a decision in respect of the Fiddington appeal had been due on 12 December 2019 but had been delayed due to the forthcoming UK Parliamentary Election and was now expected on or before 16 January 2020.
