Administration of Land Drainage Consenting and Enforcement Responsibilities

Decision Maker: Chief Executive

Decision status: Recommendations Approved

Is Key decision?: No

Is subject to call in?: No

Purpose:

Tewkesbury Borough Council (TBC) supports a countywide protocol in relation to all Consenting and Enforcement Powers on ordinary watercourses, as bestowed upon Gloucestershire County Council (GCC) as Lead Local Flood Authority under the Land Drainage Act 1991, as amended by the Flood and Water Management Act 2010. For the administrative areas of TBC; GCC will delegate the responsibilities for administering certain sections of the 1991 Act under Section 13(4) of the 2010 Act, which states that 'a risk management authority may arrange for a flood risk management function to be exercised on its behalf by another risk management authority'.

By entering into this arrangement, TBC will generate income of £22,000 per annum from GCC and it will ensure effective and tailored service delivery for TBC. In addition, TBC will be entitled to retain the fee of £50 per Land Drainage Consent Application.

Decision:

To enter into contract with Gloucestershire County Council for the administration of Land Drainage Consenting and Enforcement responsibilities in relation to ordinary watercourses for the period 2019/20.

Alternative options considered:

Option 1 - Refuse opportunity to enter into agreement and forgo income generation.
