Purpose:
Tewkesbury Borough Council (TBC) supports a
countywide protocol in relation to all Consenting and Enforcement
powers on ordinary watercourses, as bestowed upon Gloucestershire
County Council (GCC) as Lead Local Flood Authority under the Land
Drainage Act 1991. For the administrative areas of TBC; GCC will
delegate the responsibilities for administrating certain sections
of the 1991 Act under Section 13(4) or the 2010 Act, which states
that ‘a risk management authority may arrange for a flood
risk management authority may arrange for a flood risk management
function to be exercised on its behalf by another risk management
authority’.
By entering into the arrangement, TBC will generate income of
£22,600.00 per annum from GCC and it will ensure effective
and tailored service delivery for TBC. In addition, TBC will be
entitled to retain the fee of £50 per Land Drainage Consent
Application.

To enter into contract with Gloucestershire
County Council (GCC) for the administration of Land Drainage
Consenting and Enforcement of Works to Ordinary Watercourses
between Tewkesbury Borough Council (TBC) and GCC for the time
period 1 April 2020 to 31 March 2023
